Aug 1 – Aug 8, 2010 Edition Barnes And Noble Counters Suit on Nook Patent Violations

NEW YORK, NY/AUTHORLINK NEWS/August 2, 2010–Barnes & Noble moved this week to counter claims that the company has violated Xerox Corp. and Alcatel-Lucent SA patents involving the Nook electronic reader. The two claimants are asking Barnes & Noble, Inc. to pay royalties for the alleged violations. But the bookseller filed a counter lawsuit July 29 stating that neither claim is valid, and it asked the court to rule in its favor by issuing a so-called declaratory judgment that the company is not infringing on any valid patents of Xerox and Alcatel.

According to a Bloomberg report, Alcatel charges that the Nook violates seven of its patents, and Xerox says the bookseller has violated four of its patents.

Barnes & Noble spokeswoman Mary Ellen Keating and Mary Ward, a spokeswoman for Alcatel-Lucent, declined to comment on the pending litigation, but Keating did confirm the counter lawsuit has been filed by B&N. Xerox also did not respond to Bloomberg when asked for comments by e-mail.
