Prevails in Patent
LaVergne, TN/4/3/06Lightning Source Inc., a division of Ingram Industries Inc. and the leading provider of demand-based book manufacturing and distribution solutions to the book industry, learned March 31 that it has prevailed after successfully appealing a patent infringement lawsuit.
Lightning Source was informed that the United States Court of Appeals for the Federal Circuit reversed the St. Louis District Court judgment of infringement and vacated the damages award. The opinion was unanimous in finding that “no reasonable jury could find infringement on the correct claim construction.” No payment will be required for alleged damages cited in the lawsuit, originally filed by the On Demand Machine Corporation.
“We are thrilled that the court validated our position and supported our appeal, overturning the lower courts ruling,” said J. Kirby Best, President and CEO of Lightning Source Inc.
“Lightning Source was established in 1997, founded on an innovative idea that has since become an industry,” Mr. Best added.
“With over 27 million books manufactured and 4,300 publishing partners today, we look forward to moving ahead and continuing the growth of our business and services.”
John R. Ingram, Chairman of Lightning Source, noted today that Lightning Source experienced a record year in 2005 and that the court’s decision announced today is welcome news for all concerned.
“The lower court decision has been 100 percent reversed today,” Mr. Ingram said. “We look forward to helping our publisher and retailer partners serve their own customers more effectively.”
