We make every effort to provide accurate, up-to-date information on our websites, and to protect your privacy. By using Authorlink ® Writers & Readers Magazine and/or Authorlink® Books N’ Flix, you are agreeing to our terms and conditions. You acknowledge and agree that the content is provided on an “as is basis” and may contain inaccuracies, errors or omissions, depending on both the original sources and/or on our system updates. The information is provided to you with certain usage restrictions and without any warranties or guarantees of any kind. We encourage you to use multiple resources for your research.
1.1 Protecting your privacy is of utmost importance to us. The information we collect, including your full contact information, is used to communicate with you, and to analyze and troubleshoot our systems. We do not sell your information to any third parties. You have a responsibility to protect your passwords and account information from others and to periodically change your passwords to protect your data.
1.2 Third-party service providers transactions and forwarding. Please be aware that while on our site, other websites and applications that you may navigate to and from are governed by their own privacy rules. Before you disclose any information to any link you may have clicked, we encourage you to review their polices. The sites include links to other sites which are not managed or controlled by Authorlink®. We are not responsible for the content of those sites and make no representations whatsoever about data accuracy, opinions expressed in or other links provided by such other sites.
1.3 Data storage. We store several small amounts of information about you, such as your computer IP address and we place small text files called “cookies” on your hard drive to help us create a better user experience for you, and to help us improve our systems. You can delete cookies from your computer anytime. We do not combine IP addresses and cookies. However, we reserve the right to review the data where illegal activity is suspected. We also collect information about the equipment and/or software you are using to access our site (stored as log files). We do not and cannot link log files directly to individuals. Log files help us understand how to improve our website and database systems.
1.4 User information. In setting up a user account or entering into an agreement with us as a customer, we create a customer account in our system. This includes the data provided by you, your order details and, where necessary, your accounting details (“customer data”). Without this information, we would be unable to perform any services for you.
YOU AGREE THAT YOUR USE OF THE ONLINE SERVICES IS AT YOUR SOLE RISK AND YOU ACKNOWLEDGE THAT, EXCEPT AS OTHERWISE PROVIDED IN THIS AGREEMENT, THE ONLINE SERVICES AND MATERIALS ARE PROVIDED “AS IS.”
2.1 Your membership. As an authorized user (member), you have the nonexclusive, non-transferable, limited right to access and use our online services for personal research purposes. You have the right to include materials into documents, analyses, presentations or similar works for the purposes of analyses and research. You may also use material as minimal non-commercial displays on blogs, social media and other strictly non-commercial websites. The non-commercial material must be linked directly to Authorlink ® Writers & Readers Magazine and/or Authorlink ® Books N’ Flix, All other commercial use in any form is strictly prohibited, without written permission. You may not reverse engineer or reassemble any part of the material.
You must provide truthful and accurate information for your account and you must be at least 13 years of age. A user and may be required to verify one’s age if asked. We reserve the right to refuse membership to anyone.
2.2 Payment. When you join under one of our payment plans, you authorize us to charge you for use of the Services, at the posted prices. Such prices are subject to change at any time by Authorlink® and those changes will appear on our website. Personal notices of changes may not be sent to you. Your subscription will be automatically charged per the plan you choose and will automatically renew unless you cancel your subscription, or we terminate the account. Fees and charges are non-refundable.
You represent and warrant that: any credit card or other payment information you supply is true and complete, and that you will pay the charges incurred at the posted prices and that your credit card company will honor those charges. Some taxes may also be incurred. Authorlink® is not responsible for any third-party charges billed to your credit card but not authorized by you.
2.3 Cancellation. You can cancel your subscription at any time prior to the end of the subscription period. To avoid additional charges, you must cancel your subscription at least ten days BEFORE the subscription period ends. You can cancel your subscription by first logging into your account and selecting “Cancel my subscription.”
2.4 Conduct. No obscene or defamatory use is allowed. A user may not breech any proprietary, privacy, or intellectual property rights.
2.5 Intellectual Property. The content on these websites contains copyrighted materials and trademarks and other proprietary materials owned by the company or its licensors or affiliates, and all rights are reserved by these entities. You may not use the Intellectual Property for any purpose or copy all or any part of the property without written permission from the Company or the licensor or affiliate. You have no ownership or proprietary rights to any content, Intellectual Property or other material viewed by, or through the use of this site. YOU AGREE THAT YOUR USE OF THE ONLINE SERVICES IS AT YOUR SOLE RISK AND YOU ACKNOWLEDGE THAT, EXCEPT AS OTHERWISE PROVIDED IN THIS AGREEMENT, THE ONLINE SERVICES AND MATERIALS ARE PROVIDED “AS IS.”
2.6 Modification. The Company reserves the right at its discretion to modify or discontinue any document, service or policy without notifying you.
3.2 Nontransferable. Your right to use the Site and its’ services is not transferable. You may not disclose to or share your password with any other party or use your password for any unauthorized purposes.
3.3. Data Security. Our organizational and technical measures are designed to protect your data from loss, misuse, and unauthorized access, disclosure, alteration, or destruction while it is under our control. However, please be aware that the storage and transfer of data cannot always be one-hundred percent secure.
3.4 Your Personal Data And Legal Rights. You have choices about how your personal data is handled. If at any time you wish to stop all data collection by the sites, you can cancel your subscription to our services.
3.5 Linking Policy. We prohibit site caching, unauthorized hypertext links and framing of any content available through our site. You may link to the Authorlink® Books N’ Flix site only via our home page, www.authorlink.com. Images can only be used for link purposes with express written permission.
4. No warranties or representations
4.1 No guarantee. The Company does not represent, guarantee or verify the truthfulness, accuracy, or reliability of content posted on our websites. Authorlink® acts as a passive conduit for the online distribution and publication of content gleaned from various trusted database sources and some user-submitted information. We have no obligation to screen or verify information before it is posted by users or ingested from third-party sources. However, if we are notified of misinformation, we will investigate and make every good faith effort to remove or adjust the content.
5. Limitation of liability
5.1 Limits of Liability. Authorlink® shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting in any way from
(a) any errors in or omissions from the online services or any materials available or not included on our sites, (b) the interruption or inaccessibility of the websites, (c) the manner of a member‘s use of the online services or materials, (d) the loss or corruption of any data or equipment in connection with the websites, (e) the content, accuracy, or completeness of materials, (f) delay or failure in performance beyond the reasonable control of the Company, or (g) any content retrieved from the Internet even if retrieved or linked to from within the websites.
5.2 DAMAGES. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, AND UNDER NO CIRCUMSTANCES WILL THE TOTAL AGGREGATE LIABILITY OF THE COVERED PARTIES IN CONNECTION WITH ANY CLAIM ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE ONLINE SERVICES OR MATERIALS OR THIS SUBSCRIPTION AGREEMENT EXCEED THE LESSER OF YOUR ACTUAL DIRECT DAMAGES OR THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE ONLINE SERVICES (EXCLUDING ANY APPLICABLE TAXES OR DUTIES) OR ANY LINKS OR ITEMS ON THE ONLINE SERVICES OR ANY PROVION OF THE GENERAL TERMS AND CONDITIONS.
5.3 LIMITS. UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL THE COVERED PARTIES BE HELD LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, EXEMPLARY; PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, WITHOUT LIMITATION, LEGAL FEES) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THE ONLINE SERVICES, MATERIALS, OR THE FAILURE OF ANY COVERED PARTY TO PERFORM ITS OBLIGATIONS.
6. Indemnification and Disputes
6.2 DISPUTES. All disputes arising under this agreement shall be governed by and interpreted in accordance with the laws of Texas, without regard to principles of conflict of laws. The parties to this agreement will submit all disputes arising under this agreement to arbitration in Dallas, Texas before a single arbitrator of the American Arbitration Association (“AAA”). The arbitrator shall be selected by application of the rules of the AAA, or by mutual agreement of the parties, except that such arbitrator shall be an attorney admitted to practice law Texas. No party to this agreement will challenge the jurisdiction or venue provisions as provided in this section.
